Terms & Conditions – Quotes d’Azur

Article 1 – Definitions

In these Terms & Conditions, the following definitions apply:

Cooling-off period: the period within which the consumer may exercise the right of withdrawal (where applicable).
Consumer: a natural person acting for purposes outside their trade, business, craft, or profession.
Day: calendar day.
Durable medium: any tool that enables the consumer or entrepreneur to store information addressed personally to them in a way accessible for future reference and unchanged reproduction.
Right of withdrawal: the consumer’s right to cancel a distance contract within the cooling-off period (where applicable).
Entrepreneur / We / Us: Quotes d’Azur, offering products and/or services to consumers at a distance.
Distance contract: a contract concluded without the simultaneous physical presence of consumer and entrepreneur, using distance communication up to and including conclusion.
Means of distance communication: any method that can be used to conclude a contract without consumer and entrepreneur being together in the same place.
Terms & Conditions: these current general terms and conditions.

Article 3 – Applicability

  1. These Terms & Conditions apply to every offer made by Quotes d’Azur and to every distance contract and order concluded between Quotes d’Azur and the consumer.

  2. Before the contract is concluded, the text of these Terms & Conditions will be made available to the consumer. If this is not reasonably possible, we will indicate where the Terms & Conditions can be viewed and that they will be provided free of charge upon request.

  3. If the contract is concluded electronically, these Terms & Conditions may be provided electronically in a way the consumer can store on a durable medium.

  4. If additional product/service conditions apply, the consumer may rely on the provision most favourable to them in case of conflict.

  5. If any provision is invalid or annulled, the remaining provisions remain in force and the invalid provision will be replaced with a provision that most closely reflects the intent of the original.

Article 4 – The Offer

  1. If an offer has a limited validity period or conditions, this will be stated explicitly.

  2. Our offer is non-binding and may be changed or adjusted by us.

  3. We describe products as accurately as possible. Images are intended as a true representation; however, colours may vary due to screen settings.

  4. Obvious mistakes or obvious errors in the offer do not bind Quotes d’Azur.

  5. Each offer contains information about: price, any shipping costs, how the agreement is concluded, payment methods, delivery method, and whether a right of withdrawal applies or is excluded (see Article 8).

Article 5 – The Agreement

  1. The agreement is concluded when the consumer accepts the offer and meets the stated conditions.

  2. If acceptance is electronic, we will confirm receipt electronically without undue delay.

  3. We take reasonable technical and organisational measures to secure electronic transactions and payments.

  4. We may, within legal limits, assess whether we can responsibly accept the order. If we have valid reasons, we may refuse an order or attach specific conditions, stating our reasons.

Article 6 – Made-to-Order Production (Print-on-Demand)

  1. Our products are made to order. Production starts after an order is placed and payment is confirmed.

  2. Because items are produced specifically for the customer (e.g., chosen size/colour/design), availability can be limited and production times may vary.

Article 7 – Delivery & Execution

  1. We will take due care in processing and fulfilling orders.

  2. Delivery takes place to the address provided by the consumer.

  3. If delivery is delayed or an order cannot be fulfilled (fully or partially), the consumer will be informed as soon as reasonably possible.

  4. Risk of loss or damage transfers to the consumer upon delivery (unless otherwise agreed).

Article 8 – Right of Withdrawal & Returns

8.1 General rule (EU distance sales)

Consumers generally have a 14-day right of withdrawal for distance purchases, unless an exception applies.

8.2 Exception for made-to-order / personalised items (our standard products)

Because Quotes d’Azur products are made to order with the customer’s selected specifications, the right of withdrawal is excluded for goods made to the consumer’s specifications or clearly personalised (EU exception).

That means we do not accept returns or exchanges for:

  • change of mind

  • wrong size/colour chosen by the customer

  • “not what I expected” (when the item matches the description)

8.3 Problems with an order (we will fix it)

If your item is misprinted, damaged, defective, or incorrect, contact us and we’ll make it right.

Claim window: Please report issues within 30 days after delivery.

  • order number

  • description of the issue

  • clear photos of the product + packaging (and shipping label if possible)

Resolution: Depending on the case, we offer a free replacement or a refund (partial or full).

8.4 Lost packages

If a package appears lost, contact us as soon as possible so we can investigate with the carrier.

Article 9 – Prices

  1. Prices shown are in the currency displayed on the website and include/omit VAT as indicated at checkout.

  2. Shipping costs (if applicable) are shown before purchase is completed.

  3. Any import duties, customs fees, or local taxes (especially outside the EU) are the customer’s responsibility where applicable.

  4. Obvious pricing errors do not bind us.

Article 10 – Conformity & Warranty

  1. We guarantee that products conform to the agreement and the reasonable expectations of the consumer.

  2. If there is a defect or fulfillment error, the consumer must notify us within the claim window in Article 8.3 so we can provide a solution.

Article 11 – Payment

  1. Payment must be completed at checkout using the available payment methods.

  2. The consumer must report inaccuracies in payment details immediately.

  3. If payment fails, we may cancel the order.

Article 12 – Complaints Procedure

  1. Complaints about performance of the agreement should be submitted to info@quotedazur.com clearly and fully described.

  2. We aim to respond within 14 days of receiving the complaint.

  3. If a complaint requires longer handling, we will confirm receipt and provide an estimated response time.

Article 13 – Liability

  1. Our liability is limited to the value of the order in question, unless mandatory law provides otherwise.

  2. We are not liable for delays or failures caused by circumstances beyond our control (force majeure), including carrier delays, customs inspections, strikes, or technical outages.

Article 14 – Disputes & Applicable Law

  1. These Terms & Conditions and all agreements are governed exclusively by Dutch law, even if the consumer resides abroad.

  2. Disputes will be submitted to the competent court in the Netherlands, unless mandatory consumer law provides otherwise.

Article 15 – CESOP

Due to EU measures relating to CESOP (Central Electronic System of Payment Information), payment service providers may be required to record and report certain cross-border payment data to EU tax authorities.

Article 16 – Changes to These Terms

We may update these Terms & Conditions from time to time. The version published on our website at the time of purchase applies to the contract.
